These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and April ("Developer", "I", or "me") regarding your use of Marvel.ai: Generator&Enhancer (the "Product").

By accessing or using the Product, you agree to be bound by these Terms. If you do not agree, do not use the Product.

1. License and Use of Service

I grant you a personal, non-exclusive, non-transferable, and revocable license to use the Product strictly for your personal, non-commercial purposes. You shall not:

Reverse engineer, decompile, or attempt to extract the source code of the Product.
Use the Product for any illegal activities or to generate harmful content.

2. Camera and Photo Library Access

The Product requires access to your device’s camera and photo library to provide AI-generation features.

User Responsibility: You are solely responsible for the photos and videos you upload or capture.
Rights: You represent and warrant that you own or have obtained all necessary permissions and licenses to use the media you input into the Product.

3. AI-Generated Content

Ownership: Subject to your compliance with these Terms, you own the content you generate using the Product.
Accuracy Disclaimer: You acknowledge that AI-generated content may be inaccurate, biased, or inconsistent. I do not guarantee the quality, accuracy, or reliability of the output.
No Training: I do not use your input or generated content to train, improve, or develop my AI models or those of third-party providers.

4. Prohibited Conduct

You agree not to use the Product to create content that:

Infringes on any third-party intellectual property or privacy rights.
Contains sexually explicit, hateful, defamatory, or violent material.
Impersonates others or spreads misinformation/fake news.

5. Intellectual Property

All rights, titles, and interests in the Product (excluding user-input content), including its design, interface, code, and original algorithms, remain the exclusive property of April.

6. Disclaimer of Warranties

THE PRODUCT IS PROVIDED "AS IS" AND "AS AVAILABLE." AS AN INDEPENDENT DEVELOPER, I MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PRODUCT’S FITNESS FOR A PARTICULAR PURPOSE, AVAILABILITY, OR ERROR-FREE OPERATION. YOUR USE OF THE PRODUCT IS AT YOUR OWN RISK.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, April SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF DATA, PROFITS, OR REPUTATIONAL HARM) ARISING FROM YOUR USE OR INABILITY TO USE THE PRODUCT.

8. Changes to Terms

I reserve the right to modify these Terms at any time. I will notify you of changes by updating the "Last Updated" date. Continued use of the Product constitutes your acceptance of the revised Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hong Kong (or your selected region), without regard to its conflict of law provisions.
